COMPETITION’S RULES “ONE WORK – ONE VINTAGE”
December 1, 2019 to June 30, 2020.

Article 1: Organization
SCEA DOMAINE LAURENT HABRARD with a capital of 11,250 euros, hereinafter referred to as “The Organiser”, whose registered office is located at 11, ROUTE DES BLANCS 26600 GERVANS, registered under the number RCS Romans 417 513 892, is organising a free competition from December 1st 2019 to midnight on June 30th 2020.

Article 2: Participants
This free contest is open to persons who are of legal age, at the start date of the contest, residing in France or in any other country.
Minors are admitted taking part in this competition, if they have previously obtained express authorisation to do so from their parents or the person exercising parental authority. The fact that they participate implies that they have obtained this authorisation.
Persons who do not meet the above conditions are excluded from the contest, as well as members of the Organizer’s staff, and any person who directly or indirectly participated in the design, organization or management of the contest, as well as their spouse, family members: direct ascendants and descendants or other relatives living in their household or not.
Winners of previous editions of the competition are excluded from the competition.
The “organiser” reserves the right to ask any participant to justify the conditions set out above. Any person not fulfilling these conditions or refusing to justify them will be excluded from the contest and will not be able to receive their prize in the event of a win.
Only one entry per person (same name, same address) per year is allowed. The “Organizer” reserves the right to verify compliance with this rule.
Participation in the contest implies full acceptance of these rules.

Article 3: Terms and conditions of participation
The participant must create an artistic graphic work in line with the specifications below. Each year, the organizer will choose a work to illustrate the totality of the labels reserved to dress the bottles of white HERMITAGE from the Domaine Laurent Habrard of the vintage concerned.
Specifications:
The artwork will be a graphic element (painting, drawing, photo…) which will become the label for all the bottles of HERMITAGE of the vintage concerned. The dimensions of the label are as follows: height 60 mm x width 75 mm. The work must be created taking these dimensions into consideration.

THEME OF THE WORK TO BE RESPECTED:
“The Vine and the Poppy”. Two natural elements present in the vineyard. At the same time side by side but so different in what they are.
THE VINEYARD is an element anchored in the soil for a long time. It is robust and fixed. It is reborn every year. It is structured (alignment of the vines in a plot). Its skin is hard, rough. Its forms are tortured, all in roundness or length, according to the trellising. It can become very old and become very imposing and majestic.
LE COQUELICOT is very elegant. Its bright colours give it a lot of grace and beauty. It is slender and curves under the effect of the wind. Its layout is anarchic in space. It represents reasoned madness. The one that leads to beauty, creativity, carelessness that builds minds. Each year it is born again, there or elsewhere to illuminate the vineyard with red and red.
The participant must send his or her artistic graphic work ONLY BY MAIL to the organizer before June 30, 2020 at the following address: laurent@laurenthabrard.com.
A quality photo of the artwork is strongly advised so as not to penalize the jury members’ judgement.
An information sheet will be attached to the work, mentioning the name, first name, place of residence, telephone number and e-mail address of the author. If the participant is a minor, he will have to send the authorization of the parental authority.
The participant must fill in the information form completely and correctly for his or her registration to be validated. The player is informed and accepts that the information entered in the registration form is proof of his or her identity.
The participant undertakes to release the organizers from any liability in the event of claims by third parties due to copyright infringement or violation of exploitation rights or property rights of any nature whatsoever.
As part of his participation in the contest, only the winning participant irrevocably and exclusively assigns to the organizing company and/or its assignees all of the economic exploitation and intellectual and artistic property rights that he may hold on the work that he has designed and transmitted to the organizing company as part of his participation in the contest, so that the organizing company may, without restriction, reproduce, represent, exploit, adapt this work by any means and for any country and for the maximum duration of protection of intellectual property rights provided for by applicable legislation. The present session is granted free of charge and shall not give rise to any consideration of any kind whatsoever for the benefit of the participant.
Any participation effected contrary to the provisions of these Rules shall render participation invalid. Any participant suspected of fraud may be disqualified from the contest by the “Organizer” without having to justify it. Any identification or entry that is incomplete, erroneous or illegible, whether voluntarily or not, or made in any form other than that provided for in these rules shall be considered null and void. The same penalty will apply in the event of multiple entries.

Article 4: Winnings
The organizer will offer the artist who created the chosen work a batch of bottles of HERMITAGE BLANC DOMAINE LAURENT HABRARD up to 2% of the quantity produced for the vintage concerned. A maximum of 48 bottles. A gratuity of about 1680 € including tax (price ex cellar on January 1st, 2017).
At the same time, the artist will have visibility on the laurenthabrard.com website through a presentation of the character and his works as well as on the social networks belonging to the organizer.
Maximum total value: 1680 € incl. VAT.
The value of the prizes is determined at the time of drafting these rules and cannot be disputed as to their evaluation.
All expenses incurred after the competition, for the maintenance and use of these prizes, are entirely the responsibility of the winner.
If the winner resides abroad and sending the bottles is prohibited or too expensive, the organizer reserves the right to reward the person by transferring a sum of money corresponding to the value of the bottles normally offered.

Article 5: Designation of the winners
A selection committee chosen by the organizer will meet between July 1, 2020 and July 15, 2020 to determine the winner.

Article 6: Announcement of the winners
An article will be posted on the laurenthabrard.com blog by July 16, 2020 at the latest to announce the name of the winner. Only the winner will receive a message announcing his or her selection for the contest. The other participants will have to visit the Laurent Habrard domain’s blog to be informed.

Article 7: Awarding of prizes
The prize will be made available by the organizer, and at its address, as soon as the bottles are available and for a period of 3 months from the sending of the winner’s announcement e-mail.
The winners undertake to accept the prizes as offered without the possibility of exchange, for cash, other goods or services of any kind whatsoever, nor transfer of the benefit to a third party. Similarly, these prizes may not be the subject of claims for compensation.
“The organiser” reserves the right, in the event of an event beyond its control, linked to its suppliers or unforeseeable circumstances, to replace the prizes announced by prizes of equivalent value. The winner will be kept informed of any changes.

Article 8: Use of participants’ personal data
Participants’ information is recorded and used by the “Organizer” to memorize their participation in the contest and allow the awarding of prizes.
Participants may, for legitimate reasons, object to the processing of their personal data communicated in the context of this contest. They also have the right to object to their personal data being used for commercial prospecting purposes, outside of participation in this contest, which they may assert as soon as their participation is registered by writing to “The organiser” whose address is mentioned in article 1.
The winner(s) authorize the “Organizer” to use their contact information (last name, first name) for advertising or public relations purposes, on any medium whatsoever, without this conferring on them any remuneration, right or benefit whatsoever, other than the awarding of their prize.
In accordance with the French Data Protection Act of 6 January 1978, any participant has the right to demand that any information concerning him/her that is inaccurate, incomplete, ambiguous or out of date be rectified, completed, clarified, updated or deleted by writing to the “Organiser” whose address is mentioned in article 1.

Article 9: Contest rules
The rules of the competition are deposited at SELARL ACTA – PIERSON et ASSOCIES, a bailiff’s office domiciled at 15 rue de Sarre BP 15126 57074 METZ Cedex 3.
The rules of the competition will be available for consultation on the website https://laurenthabrard.com/.
It can be sent free of charge to any person who requests it from “The Organiser”.
The “Organizer” reserves the right to extend, shorten, modify or cancel the contest at any time, particularly in the event of force majeure, without participants being able to claim any compensation. The rules, as amended by amendment(s), shall be filed, where applicable, with SELARL ACTA – PIERSON et ASSOCIES, a bailiff’s office domiciled at 15 rue de Sarre BP 15126 57074 METZ Cedex 3.

Article 10: Industrial and intellectual property
The reproduction, representation or exploitation of all or part of the elements making up the competition, including these rules are strictly prohibited.
All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site as well as on the sites to which the site provides access via hypertext links are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code for the entire world. Their unauthorized reproduction constitutes an infringement punishable by law.
Any unauthorized reproduction, in whole or in part, of these trademarks, logos and signs constitutes an infringement punishable by law.
Participation in this contest implies full and complete acceptance of these rules by the participants.
Article 11: Responsibility
The responsibility of “The organizer” cannot be held liable in cases of force majeure or fortuitous events beyond its control.
“The organizer” cannot be held responsible for delays, losses, theft, damage to mail, lack of legibility of stamps due to postal services. Nor can it be held responsible and no recourse can be taken against it in the event of the occurrence of events of force majeure (strikes, bad weather, etc.) partially or totally depriving participants of the possibility of taking part in the competition and/or winners of the benefit of their earnings.
The “organizer” and its service providers and partners can in no way be held responsible for any incidents that may occur in the use of the prizes by the beneficiaries or their guests once the winners have taken possession of them.
Likewise, the “organiser”, as well as its service providers and partners, cannot be held responsible for the loss or theft of the prizes by the beneficiaries once the winners have taken possession of them. Any additional cost necessary to take possession of the prizes shall be borne entirely by the winners, without them being able to request any compensation from the “organiser”, nor from the service providers or partners.

Article 12: Litigation & Claim
The present regulation is governed by French law.
The “Organizer” reserves the right to rule without appeal on any difficulty that may arise regarding the interpretation or application of these rules, it being understood that no dispute will be allowed regarding the terms and conditions of the contest, the results, the prizes or their receipt, one month after the end of the contest. Except in the event of obvious errors, it is agreed that the information resulting from the contest systems of the “Organizer” shall have evidentiary force in any dispute as to the elements of connection and the computer processing of said contest information.
Any complaint must be sent within one month of the end date of the contest to : The “Organizer”. After this date, no claim will be accepted. Participation in the contest implies full acceptance of these rules.

Article 13: Agreement of proof
By express agreement between the participant and “The Organizer”, the computer systems and files of “The Organizer” shall be the sole authenticator.
The computerized registers, kept in the computer systems of “The Organizer”, under reasonable conditions of security and reliability, are considered proof of the relations and communications between “The Organizer” and the participant.
It is consequently agreed that, except in the case of manifest error, “The organizer” may avail itself, in particular for the purpose of proof of any act, fact or omission, of programs, data, files, records, operations and other elements (such as monitoring reports or other statements) of a nature or in a computer or electronic format or medium, established, received or kept directly or indirectly by “The organizer”, in particular in its computer systems.
The elements considered thus constitute proof and if they are produced as evidence by “The organizer” in any litigation or other proceedings, they will be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative force as any document that would be drawn up, received or kept in writing.
Operations of any kind carried out using the identifier and code allocated to a participant, following registration, are irrefutably presumed to have been carried out under the responsibility of the participant.
